Treasure to $10K Giveaway Terms & Conditions

Tortuga’s ‘Treasure to $10k Giveaway’ (the “promotion”) is administrated by Tortuga Rum Company Ltd. (the “promoter”). The promotion is governed by these official terms and conditions. By entering and participating in the promotion, each person (the “entrant”) agrees to abide by these terms and conditions, including all eligibility requirements.

Tortuga’s ‘Treasure to $10k Giveaway’ promotion runs from Monday 5th February 2024 until close of business on Friday 5th April 2024 at all Tortuga Fine Wine & Spirits and Discount Liquor stores in Grand Cayman, as well as Discount Liquors in Cayman Brac and online at www.tortuga.ky. The Promotion is restricted to retail purchases only. Tortuga’s Duty-Free stores are not included in this promotion and duty-free purchases will not be eligible to enter or win.

Customers are eligible to enter the promotion for every CI$25 spent in-store or online purchases. To enter, customers must submit their completed entry slip(s) by posting the into the entry box at any Tortuga or Discount Liquors store.

This promotion is open to legal residents of the Cayman Islands aged 18 or over, and only those entrants that meet these criteria are eligible to win. Current and ex-employees (who are within 60 days of end contract) of Tortuga Rum Company Ltd., and their immediate family members, are not eligible to participate. Tortuga reserves the right to verify the eligibility of all entrants and to disqualify any entrant if they have reasonable grounds to believe the entrant has breached any of the terms and conditions of this promotion. Winners will be asked to present a valid photo ID to claim their prize.

This promotion is also open to customers who make gift card purchases but not gift card redemptions. Retail customers who have an account with our AR department, must have settled their account in full by the close of the entry period (Friday, April 5th, 2024) to be eligible. Customers who make retail purchases online will be entered into the promotion, provided they select the appropriate box which directs them to agree to these terms and conditions. 

The 1st, 2nd and 3rd place winners will be selected at random from all valid entries and the drawing shall take place on Friday 12th April 2024. The winners will be contacted within 7 days of the draw onceeligibility has been verified. The winner will be contacted via phone first. If they cannot be reached in two days, they will be contacted via email. If the winner cannot be reached within 14 days of drawing, another winner will be drawn. Prizes must be collected within 14 business days of the winner being notified. All prizes offered are non-exchangeable and non-transferrable. The contact information provided by the entrant on the entry slip shall be what the promoter will use to contact the winners in accordance with the terms and conditions herein.  

The Promoter will not be held liable for a failure of receipt of entries. The Promoter takes no responsibility for any entries which are lost, delayed, ineligible, corrupted, damaged incomplete or otherwise invalid.  

By participating in this Contest each Entrant agrees to fully indemnify, release and hold harmless the Promotor and its subsidiaries (including their respective officers, directors, employees, representatives and agents) from any and all liability, claims, demands, losses or injury arising in whole or in part, directly or indirectly, from that Entrants participation in the Promotion, and the provision, acceptance, use or misuse of the Prize(s) that may be won. The Promotor, its affiliates or subsidiaries does not make any warranties, express or implied as to the condition, fitness, or merchantability of the Prize(s).

To the extent permitted by applicable law the Promoter shall not be liable under or in connection with these terms and conditions, the competition or any prize for any indirect, special or consequential cost, expense loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been  contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

When a Prize becomes unavailable for any reason, the Promoter reserves the right to substitute that Prize for a prize of equal or higher value.

In the event of unforeseen circumstances beyond the Promoters control the Promoter reserves the right to cancel, terminate, modify, or suspend the competition or these terms and conditions either in whole or in part, with or without notice.  

For the avoidance of doubt the Promotor may in its sole and absolute discretion, declare that an Entrant who has been drawn or selected as the winner of a Prize is ineligible to receive the Prize including where awarding such Entrant with the Prize would cause damage to the reputation or goodwill of the Promotor and or its affiliates and subsidiaries. In such a circumstance a new winner will be drawn and selected.

By participating, each entrant grants permission for Tortuga Rum Company to use the entrant’s name and image (photo/video) on social media and in marketing campaigns, should they be selected as a prize winner, for the purposes of announcing them as a winner.

By providing your email address on the competition entry slip, you consent to receive marketing communications from Tortuga Rum Company. We respect your privacy and will handle your information in accordance with GDPR regulations. You can unsubscribe at any time. Contact information collected with entries will be stored securely for a period not exceeding six (6) months before being destroyed. The contest and these official rules shall be governed by and construed in accordance with the laws of the Cayman Islands and the Courts of the Cayman Islands shall have exclusive jurisdiction over any dispute arising out of or in connection with the Promotion.
